INTRODUCTION

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Exito Sports Tech LLP ("Playbhoomi", "Company", "we", "our", or "us") governing your access to and use of the Playbhoomi mobile application, website, and related services (collectively, the "Platform").

By accessing, downloading, registering for, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. ELIGIBILITY

You must be legally capable of entering into a binding contract under applicable law. Individuals below eighteen (18) years of age may use the Platform only under the supervision and with the consent of a parent or legal guardian.

Parents and guardians are responsible for all activities performed by minors using their accounts or devices.

2. ACCOUNT REGISTRATION

Certain features require account registration. You agree to:

  • Provide accurate and complete information
  • Keep account information updated
  • Maintain confidentiality of login credentials
  • Accept responsibility for all activities under your account

Playbhoomi may refuse registration, suspend, or terminate accounts at its sole discretion where misuse, fraud, or policy violations are suspected.

3. PLATFORM SERVICES

Playbhoomi provides a technology-enabled platform that allows users to:

  • Discover sports venues
  • Browse venue availability
  • Reserve slots and make bookings
  • Make payments and receive confirmations
  • Access sports-related services

Venue operators remain independently responsible for venue operations, maintenance, safety standards, staffing, and infrastructure.

4. BOOKINGS

Bookings are subject to availability, operational constraints, venue-specific rules, and successful payment confirmation.

Users are responsible for reviewing venue details, booking dates, time slots, pricing, and venue policies before confirmation.

Booking details cannot always be modified after confirmation.

5. PAYMENTS

Payments are processed through authorized third-party payment providers including Razorpay. By making payments through the Platform, you agree to payment processor terms and applicable banking regulations.

Playbhoomi does not store complete card credentials, UPI PINs, CVV numbers, or online banking passwords. All pricing displayed is subject to correction of errors and technical inaccuracies.

6. CANCELLATIONS AND REFUNDS

Cancellation and refund requests shall be governed by the Refund & Cancellation Policy published by Playbhoomi. Unless otherwise specified, bookings may be non-cancellable and non-refundable.

Playbhoomi reserves the right to modify refund and cancellation policies from time to time.

7. VENUE RULES

Users must comply with venue operating policies, safety instructions, equipment guidelines, and applicable laws.

Venue operators may deny entry for misconduct, intoxication, unsafe behavior, or violation of venue policies. No refund shall be guaranteed in such cases.

8. USER RESPONSIBILITIES

Users shall provide truthful information, respect venue property, follow safety instructions, and use facilities responsibly.

Users shall not engage in fraudulent bookings, impersonate others, circumvent payment systems, or abuse Platform services.

9. PROHIBITED ACTIVITIES

Users shall not:

  • Reverse engineer software or copy source code
  • Scrape Platform data or use automated bots
  • Introduce malware or interfere with network operations
  • Attempt unauthorized access to systems

Violations may result in immediate suspension or termination.

10. INTELLECTUAL PROPERTY OWNERSHIP

All intellectual property rights relating to the Platform belong exclusively to Exito Sports Tech LLP or its licensors, including software, databases, logos, trademarks, and content.

No rights are transferred except the limited right to access and use the Platform under these Terms.

11. DISCLAIMERS

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. Playbhoomi does not guarantee continuous availability, error-free operation, venue quality, venue safety, or venue availability.

Participation in sports activities carries inherent risks. Users participate entirely at their own risk.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Exito Sports Tech LLP shall not be liable for personal injury, property damage, revenue loss, data loss, or indirect damages.

Aggregate liability shall not exceed the amount paid by the User for the booking giving rise to the claim.

13. SUSPENSION AND TERMINATION

Playbhoomi may suspend or terminate access immediately if fraud is suspected, security risks are identified, these Terms are violated, or required by law.

14. DISPUTE RESOLUTION

Any dispute arising from these Terms shall first be attempted to be resolved amicably. If unresolved within thirty (30) days, disputes shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.

Arbitration shall be conducted in English, take place in Indore, Madhya Pradesh, and be conducted by a sole arbitrator. The arbitration award shall be final and binding.

15. GOVERNING LAW

These Terms shall be governed by the laws of India. Subject to the arbitration provisions, courts located in Indore, Madhya Pradesh shall have exclusive jurisdiction.
